Terms of service

1. About Performa PC and these terms

Performa PC is operated by Mehiar General Trading FZE in the United Arab Emirates. In these terms, “we”, “us” and “our” refer to that business. These terms govern use of our online store and orders for products and related services, including PC components, peripherals and custom-built systems.

Our store is hosted on Shopify, which provides the e-commerce platform. Your purchase is from Performa PC, not from Shopify. Please read these terms together with our Shipping Policy, Refund Policy and Privacy Policy, and any product-specific terms or written quotation provided before purchase.

Nothing in these terms excludes, restricts or replaces any rights, warranties, remedies or liabilities that cannot lawfully be excluded under applicable consumer law. A general policy does not override an express product description or an order-specific commitment we have agreed with you.

2. Eligibility and account information

You must have the legal capacity to make the purchase, or act with the appropriate authorisation. If you order on behalf of a business or another person, you must be authorised to do so. Provide accurate contact, billing and delivery details, keep account credentials secure, and notify us promptly if you suspect unauthorised account use.

Do not submit fraudulent orders, use another person's payment details without permission, upload malicious software, seek unauthorised access to accounts, or use the store for unlawful or deliberately disruptive activity. We may take proportionate action to protect the store, without withholding refunds or other remedies required by law.

3. Product information and compatibility

The product description and the specific variant selected identify what you are ordering. Check model numbers, colours, sizes, quantities and compatibility requirements before purchase. A case, water block, mounting accessory or display kit is not a complete PC unless expressly described as one.

Images may show illustrative builds or optional accessories; only the items expressly stated as included form part of the sale. Screen settings may affect displayed colours. Benchmarks and performance examples depend on the complete system, software, settings and operating conditions and are not guarantees of a particular result.

For separately purchased components, check physical clearances, sockets, mounting hardware, tubing dimensions, electrical connectors and power requirements. Ask us for help where needed. These checks do not remove our responsibility for accurate descriptions, compatibility advice we expressly provide, or an agreed custom-build specification.

4. Prices and payment

Our store's base currency is UAE dirhams (AED). Where another display currency is available, check the payable currency and final total at checkout. Product prices include applicable UAE taxes. Delivery charges and any other charges collected by us are shown at checkout or in the agreed quotation before you commit to the purchase. International import charges not collected by us are explained in the Shipping Policy.

Available payment methods are shown at checkout or agreed in writing for a quoted order. Your payment provider may apply its own currency-conversion or transaction charges. Do not send full payment-card details, security codes or passwords to us by email.

Prices and offers may change for future orders. We will not increase an agreed order price or substitute a materially different item without your agreement. If a genuine pricing, description or availability error affects your order, we will contact you to resolve it consistently with applicable law, including any rights relating to advertised prices.

5. Orders, availability and cancellations

Please review your order before submitting it. An automated order acknowledgement confirms receipt of the order; we may still need to verify payment, availability or a requested custom specification. We will contact you promptly if we cannot fulfil the order as placed and will not supply an alternative without your agreement.

To request a cancellation or amendment, contact us as soon as possible with your order number. Whether an order can be stopped or changed depends on its preparation or dispatch stage and your rights under applicable law. If we cannot supply an item, or a cancellation entitles you to a refund, the amount due will be refunded to the original payment method unless you agree to another lawful method. Store credit is not a compulsory substitute for a refund that is legally due.

6. Custom-built PCs and special orders

For a custom PC or other made-to-order system, the written specification and quotation agreed before purchase define the components, included services, price, payment stages and estimated lead time. Any deposit or order-specific cancellation conditions must be disclosed and agreed before payment; these terms do not impose a blanket non-refundable deposit.

Assembly, testing, component sourcing and requested changes may affect the lead time. We will explain any proposed change to the specification, price or schedule and obtain your agreement before proceeding. A customised product remains subject to applicable rights concerning faults, incorrect specifications and work that does not match what was agreed.

7. Shipping, delivery and inspection

Our Shipping Policy explains delivery availability, charges, order preparation, tracking, international charges and delivery issues. The delivery arrangements shown for your order or agreed in your quotation apply. Providing an estimate does not remove your rights if an order is not supplied within the required or agreed timeframe.

Inspect delivered products and contact us promptly about damage, missing items or an incorrect order. Do not power on visibly damaged equipment. Where practical, retain packaging and provide photographs to assist an investigation; these requests do not create an absolute condition for exercising statutory rights.

8. Returns, refunds, warranties and installation

Our Refund Policy governs change-of-mind returns, exchanges and the return process, subject to applicable law. Contact us before returning an item for instructions. A restriction on change-of-mind returns, including for a customised product, does not remove rights relating to defective, damaged, incorrect or misdescribed goods.

Any commercial warranty period and its coverage are those disclosed for the product or agreed service. Manufacturer warranties, where supplied, apply in addition to mandatory consumer protections; they do not replace our legal obligations as the seller. Contact us with your order details for warranty support. We do not impose a single warranty duration on every product through these terms.

Install and use hardware according to the supplied instructions and manufacturer requirements. Use a qualified installer where appropriate, especially for electrical connections and custom liquid cooling. Damage actually caused by misuse, incompatible connections, dry-running a pump or improper installation may fall outside a commercial warranty, to the extent permitted by law. Opening, installing or modifying a product does not automatically extinguish every statutory right or excuse an unrelated defect.

9. Privacy and communications

Our Privacy Policy explains how personal information is collected, used and shared to operate the store, process payments, arrange delivery and provide support. Order-related communications are separate from optional marketing. Merely browsing the website is not consent to marketing or optional tracking; consent and privacy choices apply as required by law.

10. Website content and external services

Rights in our original text, branding and website content belong to Performa PC or the relevant rights holder. Manufacturer names, trademarks, product images and third-party materials belong to their respective owners. Personal, non-commercial use of content is permitted with notices intact, subject to applicable law; commercial reuse requires the relevant permission.

External websites and optional third-party services may have their own terms. A link does not by itself amount to an endorsement. These third-party terms do not remove our responsibilities for products or services we sell. Website access may occasionally be interrupted by maintenance or technical issues; an interruption does not cancel an existing order or remove your rights.

11. Responsibility, governing law and disputes

Our responsibilities for the goods and services we provide are determined by the agreed order and applicable law. We do not exclude mandatory liability or remedies for defective goods, misleading descriptions, failure to supply, or other matters for which liability cannot lawfully be excluded. No general website disclaimer changes an express warranty or agreed specification.

These terms are governed by the applicable laws of the United Arab Emirates, without depriving a consumer of mandatory protections that apply to their purchase. Please contact us first so we can try to resolve a concern promptly. You remain free to contact the competent consumer-protection authority or bring a claim before a court with jurisdiction; these terms do not impose compulsory private arbitration.

12. Changes to these terms and contact

We may update these terms for future use and future orders, and will revise the date above. An update does not retrospectively change an existing order without your agreement or where required by law. If a provision is unenforceable, it applies only to the extent permitted by law and does not invalidate the remaining provisions. A failure to enforce a provision on one occasion is not a permanent waiver.
